Check Recovery Investigation

State Law:

 

California Penal Code Section 476(g) authorizes the Check Recovery Investigation office to function under the direction of the West Valley-Mission College District Police Department. 

 

It is a crime to knowingly pass a check without sufficient funds and fail to pay on demand.  Pursuant to California Penal Code section 476(a), you can be criminally prosecuted carrying criminal penalties of fines and/or imprisonment.

 

In addition, California Penal Code Section 476(g) has given full authority to  sheriff's departments, police departments, or other law enforcement agonies to collect a fee from the defendant for investigation, collection, and processing of checks referred to their agency for alleged violations of this section or Section 476 of California Penal Code.

 

 

Definition of the State Law:

 

Pursuant to California Penal Code Section 476(a), any person who for himself or as the agent or representative of another or as an officer of a corporation, willfully, with intent to defraud, makes or draws or utters or delivers any check, or draft or order upon any bank or depository, or person, or firm, or corporation, for the payment of money, knowing at the time of such making, drawing, uttering, or delivering that the maker or drawer or the corporation has not sufficient funds in, or credit with said bank or depository, or person, or firm, or corporation, for the payment of such check, draft, or order and all other checks, drafts, or orders upon such funds then outstanding, in full upon its presentation, although no express representation is made with reference thereto, is punishable by imprisonment in the county jail for not more than one year, or in the state prison.

 

 

Services Fees:

 

The West Valley-Mission College District charges an initial fee of $15.00 per check that is returned to the college District.  Individuals who pay late may incur additional charge of $25.00 per check. 

 

Only Cashier's Check or Money Order will be acceptable for payment.            (PERSONAL CHECKS OR CASH WILL NOT BE ACCEPTED)

 

If you have decided not to attend classes at West Valley or Mission College, you must officially withdraw from the college or course(s).  Failing to attend class does not remove your obligation to pay fees for any course for which you are enrolled. 

 

Please direct questions regarding your financial obligations to the College Cashier or regarding withdrawal procedures to the Admissions and Records Office. Withdrawing or dropping classes does not remove your obligation to pay service fees.  Bank errors must be explained in writing from the banking firm to appeal any fees.

 

The West Valley-Mission Community College District reserve the right to refer a returned check to a collection agency if the delinquent amount is not paid in a timely manner.
